WILL ASHCROFT'S D.O.J. ARREST PREACHER
FOR PUBLIC PRAYING?

Unless the Department of Justice (DOJ) changes its posture, this Thursday, June 20, Rev. Patrick Mahoney, Director of the Christian Defense Coalition and a close friend of The Capitol Hill Prayer Alert, intends to violate a DOJ injunction that bars him from praying on a public sidewalk within 25 feet of any abortion clinic in Washington, DC. Mahoney will risk being sentenced to six-months in jail for challenging the injunction. Rev. Mahoney asks, "If our government can prohibit pro-live Americans from peacefully expressing their free speech rights on a public sidewalk outside Washington, DC, abortion clinics, what assurance does any American have that his or her First Amendment rights will be honored and protected?"

**On January 22, 1998, the Christian Defense Coalition organized a peaceful prayer vigil, with several hundred people in attendance, outside the Capitol Women's Center in Washington, DC. (The clinic now is closed, praise God!)

**Rev. Mahoney was on the public sidewalk praying and reading Scripture. No one was denied entrance to the clinic during the vigil. Yet, Mahoney was arrested and then released.

**Federal charges against Mahoney were filed by then-Attorney General Janet Reno and the DOJ under the Freedom of Access to Clinic Entrance Act (FACE). For the first time in history, the U.S. Attorney General and the Department of Justice filed charges of their own raw initiative with no injured party having come forward.

**Not only was Mahoney found guilty, but Federal Judge Gladys Kessler issued the injunction to keep Mahoney 25 feet from any abortion clinic in Washington, DC. The injunction had been requested by Reno and the DOJ.

**In May of 2001, after appealing the injunction, the U.S. Circuit Court of Appeals vacated (or removed) the injunction and sent it back to the lower court and the DOJ. This seemed like good news since John Ashcroft was now the U.S. Attorney General and the head of the DOJ.

**In January 2002, Ashcroft filed a motion requesting that a new order be issued. Again, Judge Kessler granted it. Again, in a case with no injured parties, Ashcroft and the DOJ sought the federal courts to issue an injunction barring protected speech on public sidewalks outside abortion clinics in our nation's capital.

Rev. Mahoney believes he is called of God to challenge unlawful and unconstitutional actions against the pro-life movement. Therefore, he will stand on the public sidewalk in front of an abortion clinic in Washington, DC, at noon on Thursday, reading Scriptures and praying. What will the Bush Administration and John Ashcroft's Department of Justice do?
