ACLU Lawsuit Set for October

My people are destroyed for lack of knowledge... Because you have forgotten the law of your God, I also will forget your children (Ho 4:6).

Judge Roy Moore, who in 1995 refused to remove a wooden engraving of the Ten Commandments from his courtroom wall and later was elected Chief Justice of the Alabama Supreme Court, is now being sued by several national groups for authorizing placement of a 2 ton, granite Ten Commandments monument in the Rotunda of the Alabama Judicial Building in Montgomery. The trial is scheduled to begin October 15, 2002.

**Two separate lawsuits have been filed, one by the ACLU and Americans United for the Separation of Church & State (AU), another by the Southern Poverty Law Center (SPLC). The suits, now joined, seek an order to remove the monument arguing that that it is unconstitutional.

**State Attorney General Bill Pryor appointed Wyoming attorney Stephen Melchior chief counsel for Moore's defense and widely respected constitutional experts Herb Titus and John Eidsmoe as associate counsels. Judge Moore's defense must be paid for with private funds.

**Moore is also under fire for a recent decision in which a lesbian woman's request for custody of her three children was denied. The court ruled unanimously (9-0). National homosexual advocacy groups targeted Moore, lodging formal ethics charges and calling for his resignation because in his concurring decision Moore referred to scripture and condemned homosexuality as "abhorrent, immoral, detestable, a crime against nature" and "inherently evil." Sodomy is still a crime in Alabama.

**Moore has been at odds with the Alabama political establishment since he ran for Chief Justice and with a tiny campaign war chest, beat a prominent, much favored Democrat Civil Appeals judge.

**Moore came to national prominence when in 1995 the Alabama ACLU, demanding that he remove a small wooden Ten Commandments plaque displayed in his Etowah County Circuit courtroom, sued him. In 1997, Circuit Court Judge Charles Price ordered Moore to remove the plaque. Moore again refused and Price threatened to remove it forcibly. Gov. Fob James intervened, threatening to call out the State Police and to mobilize that National Guard, if necessary, to prevent anyone from attempting to remove the plaque.

Judge Moore vows, "I will fight them with everything and every ounce of strength I have, because what they're coming against is not me, but... against truth." His attorneys have asked Christians to pray for Judge Moore and this lawsuit. Moore's legal case, expected to reach the U.S. Supreme Court, will cost hundreds of thousands of dollars.
